The following contractual conditions apply for all orders made on our website and concerning our
products
1/SMALL PACKETS AND WHOLESALE ORDERS
The difference between Small packets and wholesale is that shipping cost is already included in the
price of each small packet. As to wholesale, the shipping cost is to be added to the seeds prices.
-SMALL PACKETS
Each packet contains 10 seeds.
The price includes airmail postage to anywhere in the world.
Several small packets can be ordered as many as you want in the same time.
-WHOLESALE
The minimum quantity for wholesale is 50 seeds. Above 100 seeds you are requested to contact us for a
special quote.
For WHOLESALE the shipping charges are to be added to price of the seeds ordered.
2/PAYMENT OF YOUR ORDER
All prices are solely in EUROS excluding taxes.
For payments of more than 150 euros, we accept wire transfer. However, due to the high fees we
need to pay to our bank when receive wire transfer, we solely accept WESTERN UNION or
MONEYGRAM for payments of less than 150 euros.
Because we are located in Africa, we cannot unfortunately propose Paypal to our customers. We hope
that we will be able to propose it in 2009.
3/PHYTOSANITARY CERTIFICATE
Phytosanitary certificate is provided on request. However we are not responsible if, pursuant to the
regulations of your country, your order is refused, confiscated or destroyed by customs because of the
lack of phytosanitary certificate.
It may be better to request a phytosanitary certificate when placing your order, even for small packet
order. The amount of such certificate is only 06 euros.
Additional costs such as phytosanitary certificates, phytosanitary inspection, treatments, or similar
necessary costs may be added to your bill where applicable and cannot be reimbursed if an order is
cancelled or the product is exchanged or returned.
4/PHOTOS
All photos representing our products (seeds, etc.) serve solely for illustrations or examples purpose.
Therefore there could be a difference between them and the delivered products.
All details in the catalogue, newsletter and on the website are given without guarantee and are subject
to errors.
5/ ORDER CANCELLATIONS
Cancellations will only be accepted for orders not yet processed.
Given the delicate nature of these goods there is no legal right to return seeds once delivered.
6/GUARANTEE OF GERMINATION
Given the delicate nature of these goods and the specific conditions of the place you are located, there
is no guarantee of viability or germination.
We do our best effort to provide fresh seeds but we are not at all reliable if the seeds sold do not
germinate well or not. Therefore there is no replacement and no refunding.
7/LIABILITIES
We reserve the right to decline orders (without offering a reason) for economic reasons. Where a product
is sold out, a substitute of equal value will only be given where expressly requested.
Shipping and importation are at your risk and expense. Costs incurred through import duties,
inspection charges, treatments and the like are solely your responsibility.
We shall not be held liable for failing to comply with your country's import regulations. It is your
responsibility to inform yourself about any regulations and requirements concerning the import of our
products.
We shall not be held liable for any damages or expenses incurred by or through the purchase of our
products.
8) GOVERNING LAW AND JURISDICTION
All orders placed with okapigarden.com are governed by laws of Republic of TOGO.
Togolese courts have exclusive jurisdiction to settle any dispute arising out of or in connection with any
order placed with okapigarden.com.
